Acceptable Use Policy
Pursuant to Calbright College’s (“Calbright”) Computer(s) and mobile Wi-Fi hotspots (“Internet Hotspot(s)/ Device(s)”) Program, Calbright may make Computer(s) and/or Internet Hotspot(s)/ Device(s)’s available, free of charge, to learners enrolled in Calbright (“Learners”). Learners have the option of participating in Calbright’s Lending Library Program or Calbright’s Bring Your Own Device Program (BYOD). All learners who receive a Computer(s) and/ or Internet Hotspot(s)/Device(s) under any Calbright device program agree to abide by the following:

- All Learners who receive a Calbright-issued Computer(s) and/or Internet Hotspot(s)/Device(s) shall abide by all applicable Board Policies and Administrative Procedures.
- Learners shall exercise all due and reasonable care in handling and use of the Computer(s) and/or Internet Hotspot(s)/Device(s). As part of this responsibility, Learners shall, among other things:
- Transport the Computer(s) and/or Internet Hotspot(s)/Device(s) in a safe manner and store the Computer(s) and/or Internet Hotspot(s)/Device(s) in a secure location when not in use.
- Keep the Computer(s)s and/or Internet Hotspot(s)/Device(s) clean with no attached stickers or other items that might deface or damage the Computer(s)’s and/or Internet Hotspot(s)/Device(s)’s nish, screen, or other components.
- Monitor the condition of the Computer(s) and/or Internet Hotspot(s)/Device(s), and immediately report any and all malfunctions, damage, or loss of a Computer(s) and/or Internet Hotspot(s)/ Device(s) to a Calbright official or technology support staff member. This includes, among other things, a virus or other malware detected on the device.
- Calbright accepts and acknowledges the reasonable and normal wear and depreciation in
value of the Computer(s) and/or Internet Hotspot(s)/Device(s). The Learner accepts and acknowledges responsibility for damages when: (1) damage to the Computer(s) and/or Internet Hotspot(s)/ Device(s) is intentional; and (2) the Computer(s) and/or Internet Hotspot(s)/Device(s) is stolen from an unsecured car or locker, or unattended bag.- If a Computer(s) and/or Internet Hotspot(s)/Device(s) is stolen, the learner must file areport with the appropriate law enforcement agency within 48 hours from the time the
learner has or reasonably should have knowledge the device is lost or stolen. The
learner must also report the stolen device to Calbright ocials within the same 48 hour
period. To receive a replacement Computer(s) and/or Internet Hotspot(s)/Device(s), the
learner must provide a copy of the police report to Calbright officials.
- If a Computer(s) and/or Internet Hotspot(s)/Device(s) is stolen, the learner must file areport with the appropriate law enforcement agency within 48 hours from the time the
- No Learner shall attempt, without Calbright permission, to modify, reconfigure, install software, or repair the Computer(s) and/or Internet Hotspot(s)/Device(s). Any modifications, upgrades, or repairs made shall become Calbright property.
- Learners will use their Computer(s) and/or Internet Hotspot(s)/Device(s) solely for
Calbright-related purposes that Calbright faculty, administrators, or employees have assigned or approved. Inappropriate uses include, but are not limited to, using Calbright-issued devices to do any of the following:- Access, post, display, or otherwise use material that is discriminatory, defamatory,
obscene, sexually explicit, harassing, intimidating, threatening, or disruptive - Access, share, transmit, post, display, publish, or otherwise use material that could be
construed as harassing or disparaging of another based on their race/ethnicity, national
origin, sex, gender, gender identity, gender expression, sexual orientation, age,
disability, religion, or political beliefs - Send/transmit, download, upload, or post messages that may be considered physically,
sexually, or verbally threatening or harassing via text, email, comment, or post - Disclose or in any way cause to be disclosed condential or sensitive Calbright, employee, or Learner information without prior authorization from a Calbright administrator
- Engage in personal commercial or other for-prot activities without permission of the
Superintendent or designee - Engage in unlawful use of Calbright technology for political lobbying
- Infringe on copyright, license, trademark, patent, or other intellectual property rights
- Intentionally disrupt or harm Calbright technology or other Calbright operations (such as destroying Calbright equipment, placing a virus on Calbright devices, adding or
removing a computer program without permission, changing settings on Calbright- issued devices) - Install unauthorized software
- Invade the privacy of another
- Engage in or promote unethical practices or violate any law or Board Policy,
Administrative Procedure, or Calbright practice - Send unsolicited email messages, including advertising material and/or requests for
fundraising for personal or private causes - Complete port scanning or security scanning
- Introduce honeypots, honeynets, or similar technology
- If a Learner is unsure whether a use is appropriate, he or she shall consult with a Calbright official prior to engaging in such use.
- Access, post, display, or otherwise use material that is discriminatory, defamatory,
- Calbright has the right to monitor the use of all Calbright systems, property, and equipment for improper use without advance notice or consent. Learners understand and acknowledge that there is no reasonable expectation of privacy in Calbright-issued devices, and Calbright may revoke access to such devices or require Learners to provide Calbright with access to the device in the event that there is a reasonable suspicion of wrongdoing and/or for an instructor to access Learner work product in conjunction with curriculum and instruction.
- Learners understand that they have no ownership over, interest in, and no right to title to the
Calbright-issued Computer(s) and/or Internet Hotspot(s)/Device(s) unless expressly authorized or permitted by Calbright. - Calbright is the sole owner of the software included with the Computer(s) and/or Internet Hotspot(s)/Device(s). Any copying, modification, merging or distribution of the software by the learner is prohibited. Learners are responsible for complying with any and all hardware, software and service provider licensing agreements, terms of use, and applicable state and federal copyright and other intellectual property protections.
- Learners who are in material breach of this agreement and/or who deny any of Calbright’s
ownership rights to the Computer(s) and/or Internet Hotspot(s)/Device(s) may be subject to
disciplinary action and/ or referral to law enforcement. - Calbright may allow Learners to access Calbright procured software, programs, and curriculum and instructional materials via their personal devices pursuant to Calbright’s Bring Your Own Device program. Learners are fully responsible, at all times, for any personally owned devices used to access Calbright’s curriculum and instructional materials should follow all applicable rules outlined in this Acceptable Use Policy when using personally-owned devices to access Calbright software, programs, and curriculum and instructional materials.
- Indemnification: By participating in Calbright’s Lending Library Program for participation in Calbright programs, Learners agree to reimburse and hold Calbright harmless from and against any and all liabilities, costs, and damages (including attorneys’ fees) which arise out of or relate in any way to the use of, misuse of, or failure to return a Calbright-issued Computer(s) and/or Internet Hotspot(s)/Device(s).
- All Learners who receive a Calbright-issued Computer(s) and/or Internet Hotspot(s)/Device(s) shall abide by all applicable Board Policies and Administrative Procedures.
